Outdoor Explorers Malta (OEM) offers multiple excisions, activities, and boat trips in Malta, Gozo, Comino, and Blue Lagoon.

The following booking conditions form the basis of your contract with Outdoor Explorers Malta (“we”, “us”, “our”, and (OEM)). Please read them carefully as they set out our respective rights and obligations. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions and agree to them.

  • OEM can not be held responsible for any loss, damage, accident, injury, sickness, schedule change, or other factors due to weather, strike, natural disasters, or any other cause beyond OEM control.
  • We reserve the right to change routes as well as start and end locations when weather conditions, underwater currents, shallows, or other legitimate reasons so require. We will, as far as possible, inform passengers thereof in a timely manner.
  • The skipper/Guide is always in charge. Safety is paramount.
  • By booking your activity with (OEM) you are accepting the terms and conditions and agreeing to the Waiver conditions of (OEM).

 

Special offers & promotional codes

  • Please note that special offers such as promotional codes cannot be applied to a reservation after a purchase has been made such as in the form of a refund. When offered, promotional codes and/or other special offers must be entered into the relevant field located on the payment page upon check out at the time of booking in order to be valid and applied.
  • Please note that all special offers such as promotional codes and/or early bird discounts only apply to the price of the tour. Extras are not subject to discount.
  • Coupons are only valid if you book with Outdoor Explorers Malta directly
  • Our Offers may not be combined with any other sale, promotion, (early bird) discount, code, coupon, and/or offer

 

Private Boat Charters

  • Private boat charters are private boat trips with a skipper. We have various boats and the price depends on the number of people, the charter you are after, and the size of the boat.
  • All our trips, tours and charters can be customized, please contact us and we will customize the trip for you.
  • Our charter trips in Malta Gozo and Comino take place in an open boat. If you are on a sunset charter or boat charter on cooler days, a fleece or a hoody is advisable.
  • Clients (including groups) for excursions, activities, and Gozo Comino and Malta boat trip shall be present 5 minutes before departure at the departure point agreed in the booking. If the clients are late, the tour will still finish at the scheduled time. Waiting time is always sailing time. Waiting time can not be added at the end of the trip.
  • It is allowed to bring a small dog during the cruise. Sitting on your lap or under the bench. Do not use a pillow for the dog.
  • It is allowed to smoke on board, only during a private cruise.
  • Passengers should note that one enters the boat by stepping off the quay onto the boat. Unfortunately, the boat is not wheelchair accessible.
  • There is no toilet on board. There are toilets available at the Starting points, Blue lagoon, and some other stops around the island.

 

Waiting periods and delays

If the group arrives late the skipper will determine whether to cancel or to sail. Waiting time is always sailing time. Waiting time can not be added at the end of the trip.

Execution of the contract

  • Valid reasons for the annulment of the contract are weather conditions (hard storm and/or high water, hindering, or making the cruise impossible. The skipper determines in the first instance whether such conditions apply.
  • In case of misconduct, whether or not caused by alcohol consumption, the skipper has the right to pause or immediately terminate the trip. Persons who are already under the influence of alcohol/drugs at the start of the tour will be denied access to the boat. The customer’s payment obligation remains existent.
  • Alcohol under the age of 18 is prohibited. OEM reserves the right to request a photo ID.
  • Passengers must follow all instructions of OEM or its employees promptly and without delay. Access to vessels and jetties may be denied without a reason being provided, should this be deemed necessary by OEM, for example in relation to capacity, safety, public order, or the imminent threat of damage or nuisance.

Liability Outdoor Explorers Malta

  • OEM is not liable for any damage to and/or loss of the passenger’s property. The passenger takes all their property on board / on tour entirely at their own risk.
  • OEM is not liable for damages to individuals or passengers’ goods, caused by entering or boarding a jetty/boat/ segway or other OEM activities. The passenger enters these areas entirely at their own risk.

Liability passenger

  • The passenger is liable for damages caused by the passenger to the property/goods used by OEM or third parties.
  • All activities organized by OEM take place entirely at the passengers’ own risk.

General Liability

  • OEM is not liable for personal injury or damage of any nature, regardless of its cause, prior, during, or as a result of the trip/tour or charter.
  • Children fall under the responsibility of the parent(s). Children under the age of 4 are required to sit on their parents’ lap. On request, a life jacket can be provided.
  • Should OEM not be able to comply with their obligations due to force majeure, there is no entitlement to restitution or compensation.

 

Payment, Refunds, and Cancellation

  • In the case of a group booking: in agreement with our offer, we will first send you a confirmation of the booking and within two days an invoice. The invoice shall be paid before the trip.
  • The client may cancel the order in writing only.
  • If you cancel your tour, trip, or charter 48 hours in advance, we will refund you the full amount of the original payment.
  • If you cancel your tour, trip, or charter in less than 48 hours in advance there will be no refund of the original payment.
  • Refunds – Seasickness, not feeling like doing the tour, personal health, inability to equalize, not liking the weather, or any other circumstantial or personal situations that are outside of our control are not valid reasons for a refund, and will not be accepted.
  • Weather – Most of our outdoor activities are weather-dependent sports, and our experienced team will always make sure that your safety is our top priority. We’ll always choose the best location that we can for our activities. In the event that the weather forces us to cancel an activity, you will be offered an alternative date or a refund.

 

Final Provisions

  • Passengers shall be deemed to follow the instructions of the crew on the quay, jetty, and boat. In the case of Segway hikes or snorkel tours, instructions are given by a professional guide before the start of the tour.
  • Wearing stiletto heels are strongly discouraged for reasons of safety and damage.
  • The passenger is expected to take care of the environment and not to dispose of waste in the water or nature. All personal consumptions and the associated waste should be taken off the boat after the end of the trip.
  • Obvious errors and mistakes in the information provided, and/or published by OEM will not bind OEM.

 

Complaints

  • If the participant finds a shortcoming in the implementation of the agreement, OEM shall be notified as soon as possible, so that OEM can find an appropriate solution. If the shortcoming is not resolved within a reasonable period of time and affects the quality of the arrangement or activity, this should be reported as soon as possible to OEM.
  • If the complaint is not satisfactorily dealt with on the spot, it can be submitted within 14 days from the end of the arrangement or activity in writing to OEM. A clearly specified account of what the complaints are should be presented.
